Item 7.01.   Regulation FD.
The following information is being furnished pursuant to Item 7.01 of Form 8-K. This information shall not be deemed “filed” for purposes of Section 18 of the Securities Exchange Act of 1934, as amended, nor shall it be deemed incorporated by reference in any filing under the Securities Act of 1933, as amended, except as shall be expressly set forth by specific reference in such filing.
On November 3, 2008, PRG-Schultz International, Inc. (“PRG”) filed a protest with the United States Government Accountability Office (“GAO”) asking the GAO to review the contracts award decisions of the Centers for Medicare and Medicaid Services (“CMS”) in connection with the national rollout by CMS of the Medicare Recovery Auditing Contractor (“RAC”) Program. As previously announced, PRG was not selected by CMS to participate in the national rollout of the RAC Program. The protest was filed by PRG following its review of the written debriefing provided by CMS with respect to the selection of recovery audit contractors for the RAC Program. No assurance can be provided that the protest will be successful or that, if successful, PRG will be subsequently selected to participate in the RAC Program.
