On August 31, 2009, the Registrant issued a press release announcing that it has signed a nonbinding settlement proposal with American Shipping Company ASA that seeks to settle all outstanding commercial disagreements between the two companies. A copy of the press release is attached to this Report as Exhibit 99.1 and hereby incorporated herein by reference.
